These terms govern your use of all ReadTomato services, including content creation, website optimization, and digital marketing tools. Plain English, no surprises.

01 Services We Provide
ReadTomato ("we," "us," "our") provides digital content and marketing services to professionals and businesses ("you," "Client"). Our current service offerings include:
Hot Take Engine Expert Content Pipeline
We conduct recorded interviews with you (or your designated representative), then produce SEO-optimized blog articles, social media content, featured images, and structured data from those interviews. Content is generated using a combination of AI tools and human editorial oversight.
WebReno Website Optimization
We analyze, audit, and optimize your existing website for search engine performance, content structure, technical SEO, and answer engine optimization (AEO). This may include modifications to your site's content, metadata, schema markup, and internal linking.
SEO & AEO Services
Ongoing search engine optimization and answer engine optimization, including keyword tracking, Google Search Console integration, content performance monitoring, and strategic recommendations.
Social Media Content
Branded social media images, captions, hashtag sets, and publishing-ready content packages derived from your interview content, delivered via your client portal.
We may introduce additional services (such as Instant Take, client dashboards, or other tools) over time. New services will be governed by these terms unless separate terms are provided. We will notify you when new services become available.
02 Your Role
For our services to work well, we need your participation. As a Client, you agree to:
Participate in scheduled interviews and provide honest, accurate information about your expertise, experience, and business
Respond to communications (email, messaging) in a timely manner when your input or approval is needed
Provide accurate credentials, including website access, business details, and professional qualifications as represented
Review content within the timeframes provided. Content published after the review window closes is considered approved by you
Notify us of errors in published content within 14 days of publication so we can correct them
Not misrepresent your qualifications, credentials, licensing, or professional standing during interviews or in content inputs
03 Content Ownership & Licensing
Your Expertise, Your Name
The knowledge, opinions, and expertise you share in interviews are yours. We don't claim ownership of your ideas or professional insights. All content is published under your name and byline as the credited expert.
Our Work Product
The articles, images, social content, and other deliverables we create are works produced by ReadTomato using your interview material as the source. Upon payment in full for the applicable service period:
You receive a perpetual, non-exclusive license to use, republish, and distribute all content we create for you
ReadTomato retains a non-exclusive license to use the content in our portfolio, case studies, and marketing materials (with your name and attribution, unless you opt out in writing)
ReadTomato retains ownership of our proprietary processes, tools, templates, and systems used to create your content
Confidential Content
If you designate specific content as confidential in writing before publication, we will exclude that content from our external marketing, portfolio, and educational use. Confidentiality requests made after publication will be honored on a best-effort basis.
Interview Recordings
Interview recordings are used solely for content production. Recordings are stored securely and are not shared with third parties. You may request deletion of raw recordings at any time after content has been produced.
Plain English: You own your expertise. We own our process. The content we make together, you can use forever. We can show it off in our portfolio unless you tell us not to. If something is sensitive, tell us before we publish and we will keep it out of our marketing.
04 AI Tools & Automated Systems
ReadTomato uses artificial intelligence tools and automated systems across multiple aspects of our service delivery. This section covers how AI is used in content production and in live client interactions.
4.1 — AI in Content Production
We use large language models and image generation systems as part of our content production pipeline. Here is what that means for you:
AI assists, humans oversee. AI is used to draft, structure, optimize, and enhance content derived from your interviews. Our editorial process includes human review and quality scoring
Images are AI-generated. Featured blog images and social media graphics are created using AI image generation tools. These images are original works, not stock photos, but they are not photographs of real scenes
Your words, refined. Content is derived from what you actually said in your interview. AI does not fabricate expertise, credentials, or claims. If a factual error appears in content, it originated from the interview material or our editorial process, and we will correct it promptly upon notification
No guarantees of uniqueness. While AI-generated content is produced specifically for you, AI systems may generate similar phrasing or structures for different users of the same tools. We optimize for originality but cannot guarantee absolute uniqueness of every sentence
Evolving technology. The specific AI models and tools we use may change over time as the technology improves. Our commitment to quality, accuracy, and your voice remains constant regardless of the underlying tools
AI-generated content and intellectual property. AI image generation and text generation tools use trained models that may, in rare cases, produce output bearing similarity to existing copyrighted works. ReadTomato uses commercially reasonable efforts to source and generate original content, but does not warrant that AI-generated images or text are free from all potential intellectual property claims. If a third party raises an infringement claim against AI-generated content we placed on your site, ReadTomato will promptly remove or replace the content at no charge. Liability for AI-generated content is governed by Sections 12 and 13 of these terms
4.2 — AI in Live Sessions & Client Interactions
ReadTomato may use AI-powered tools during live video sessions, including interviews, onboarding calls, and other client meetings. These tools support our team in real time to improve service quality and efficiency.
What these tools do. AI tools may observe and process conversation content during live sessions to assist with note-taking, action item capture, topic tracking, session documentation, and follow-up coordination
What these tools do not do. AI tools used in live sessions do not independently contact you, make decisions on your behalf, or take actions outside the scope of the session. Any follow-up communications are initiated by authorized ReadTomato team members
Data handling. Content processed by AI tools during live sessions is subject to the same data handling, retention, security, and deletion policies described in Section 7 and our Privacy Policy
Consent. By participating in scheduled sessions with ReadTomato, you consent to the presence of AI-assisted tools during those sessions. If you prefer sessions without AI tools present, notify us in advance and we will accommodate your request
Expanded use. AI tools may be introduced to additional interaction types over time (for example, review sessions or strategy calls). We will notify you of material changes to how AI tools are used in live interactions
Disclosure: Some industries or platforms require disclosure that content was created with AI assistance. It is your responsibility to add any disclosures required by your industry's regulations, licensing body, or the platforms where you republish content. We are happy to advise on standard disclosure language if needed.
Plain English: We use AI to make your content better and to make our live sessions more productive. AI helps our team during calls — taking notes, tracking action items, keeping things organized. It does not contact you on its own or make decisions for you. If you ever want a session without AI tools, just say the word.
05 Approvals, Revisions & Scheduling
Topic Approval
Topics are shared with you before your interview. You can request changes at any time via email or through your topics page. No response is considered a passive approval, and those topics will be covered in your upcoming interview.
Content Review
By default, completed articles are published to the backend of your WordPress site, scheduled at the appropriate cadence (typically twice weekly). If any content needs to be backdated due to a gap in publishing, those posts will be saved as Drafts for your review and manual publishing. Articles scheduled into the future are set to auto-publish, giving you time to review them before they go live at their scheduled date.
Some clients prefer all content delivered as Drafts for manual review. If you have a publishing preference, let us know and we will honor it as a standing rule on your account.
Revisions
All revisions are included during the production period of your latest content run
Revision requests for older articles (from previous runs) may be billed at the hourly rate defined in your service agreement
If you reject topics without providing replacements or clear direction, we may substitute relevant evergreen topics aligned with your audience
Scheduling & Backdating
Publishing cadence may be staged, bi-weekly, or otherwise adjusted to maintain consistency. We may backdate posts to maintain cadence when production timelines require it. Backdating does not negatively impact SEO performance.
Plain English: We send you topics before your interview. If you don't weigh in, we cover them. Content gets published to your site on a managed schedule. Revisions are included for the current batch. We keep the train moving.
06 Publishing & Distribution
We publish to your website on agreed-upon schedules using credentials you provide. Published content goes live according to the publishing calendar unless you request a hold
Social media content is delivered, not posted. We provide publishing-ready social content packages. You (or your team) are responsible for posting to your social platforms
SEO and schema markup are added to published content automatically. This includes structured data, meta descriptions, FAQ markup, and other search optimization elements
You can request changes to published content at any time. Routine edits (titles, corrections, image swaps) are included. Major rewrites or content pivots may be scoped separately
Search engine indexing happens naturally after publication. We may submit content to search engines proactively. We do not guarantee specific rankings, traffic levels, or search visibility outcomes
07 Data & Privacy
We take your data seriously. Our full Privacy Policy covers in detail what we collect, how we use it, which third-party services process your data (including AI providers), your rights regarding your data, and how we comply with privacy regulations including CCPA and GDPR.
The key points:
We do not sell your data. We do not share your personal information, interview content, or business data with third parties for marketing or advertising purposes
Your interview content is processed through AI providers (Anthropic, Google, OpenAI) solely for content production. These providers do not use your data for model training
We retain your data for the duration of our service relationship plus 12 months. You may request data deletion at any time, subject to our legal record-keeping obligations
You provide us with website (WordPress) access credentials to publish content on your behalf. These credentials are stored securely and used only for authorized publishing activities
You are responsible for the security of your own accounts. If you believe credentials have been compromised, notify us immediately and we will rotate or revoke our access
We access your website only for agreed-upon services (publishing, optimization, schema updates). We will not make changes outside the scope of our services without your permission
You can revoke our access at any time. Doing so may impact our ability to deliver certain services
8.2 — ReadTomato Publisher Plugin
To facilitate content publishing, ReadTomato may install a proprietary WordPress plugin ("ReadTomato Publisher") on your website. By agreeing to these terms, you consent to the installation and use of this plugin as described below.
What the plugin does. The ReadTomato Publisher plugin enables automated content publishing, post scheduling, publishing status synchronization, and related content management functions between your WordPress site and ReadTomato's production systems
What data it transmits. The plugin transmits post metadata, publishing status, and site health signals to ReadTomato's systems over encrypted channels. It does not collect personal visitor data, browsing analytics, or any information unrelated to content publishing
Updates & maintenance. ReadTomato may update the plugin remotely as part of ongoing service maintenance. Updates are designed to maintain compatibility, security, and functionality. We will notify you of any updates that materially change the plugin's functionality
Compatibility. The plugin is designed to be lightweight and tested against standard WordPress configurations. ReadTomato is not liable for conflicts with third-party plugins, custom themes, or non-standard hosting configurations, but we will work with you to resolve compatibility issues that arise
Your right to remove. You may remove or deactivate the plugin at any time. Removing the plugin may impact our ability to deliver automated publishing services, and we may need to revert to manual publishing workflows
Removal on termination. Upon termination of services, the ReadTomato Publisher plugin will be removed from your website within 7 days, consistent with our credential revocation timeline in Section 14
Security. All communication between the plugin and ReadTomato systems occurs over encrypted (HTTPS) channels. The plugin does not create backdoor access, does not grant admin-level privileges beyond content publishing scope, and does not modify your site's core files
Plain English: We install a small plugin on your WordPress site so we can publish your content automatically instead of logging in manually every time. It only handles content publishing — it does not track your visitors or collect anything beyond post data. You can remove it anytime, and we remove it when we part ways.
09 Payment & Billing
Service fees are as agreed in your individual service agreement, proposal, or invoice
Payment is due according to the terms specified in your invoice (typically net 15 or net 30)
Accounts more than 14 days past due may experience paused or delayed production
Accounts more than 30 days past due may be suspended and will incur a late fee of 5% per month on the unpaid balance
Content that has been produced but not yet published will be held until payment is resolved. Content already published to your website remains live regardless of payment status
Pricing may be adjusted with 30 days written notice. You may cancel rather than accept a price increase
Retroactive billing: If services were delivered but not invoiced due to administrative or technical error, we may issue a corrected invoice for services rendered within the prior six (6) months. You will receive an itemized notice and 30 days to pay or arrange a payment plan
10 Representations & Accuracy
This section matters. Read it carefully.
You represent that the information you provide in interviews is truthful and accurate to the best of your knowledge. This includes your professional credentials, business claims, transaction history, rankings, and client outcomes
We rely on your representations when creating content that positions you as an expert. If you claim to be "#1 in your market" or cite specific statistics, we publish those claims under your byline based on your attestation
We do not independently verify professional claims, licensing status, transaction counts, or other credentials you provide. Verification is your responsibility
If claims change (a ranking shifts, a credential expires, a statistic becomes outdated), it is your responsibility to notify us so we can update published content
Regulatory compliance for your industry's advertising and marketing rules is your responsibility. We will make reasonable efforts to follow guidelines you provide, but you are the expert in your field's compliance requirements
Images and media you provide. If you upload, submit, or request that we use specific images, photographs, graphics, or other media on your website, you represent and warrant that you own or have obtained proper licenses for that material. You agree to maintain records of permissions or licenses and provide them to ReadTomato upon request
Why this matters: We are a content production company, not a compliance auditor. We build great content from what you tell us. The accuracy of what you tell us is on you.
11 Warranty Disclaimer
All ReadTomato services and related materials are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or that any specific results will be achieved
We do not guarantee search engine rankings, website traffic, lead generation, or revenue outcomes
The tools, platforms, and AI models we use may change over time. Equivalent tools may be substituted without notice if functionality is substantially similar. Our commitment to deliverable quality remains constant regardless of the underlying tools
Plain English: We are very good at what we do and we stand behind our work. But we cannot guarantee that Google will rank you #1 or that your phone will ring off the hook. Too many variables are outside our control. What we can guarantee is professional, consistent, best-practice work.
12 Limitation of Liability
To the maximum extent permitted by applicable law:
ReadTomato's total liability for any claims arising from our services shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim
We are not liable for:
Indirect, incidental, special, consequential, or punitive damages
Lost profits, lost business, or lost revenue
Search engine ranking changes, algorithm updates, or traffic fluctuations
Third-party actions (hosting outages, platform policy changes, social media algorithm changes)
Content accuracy issues arising from information you provided
Regulatory or compliance issues in your industry related to content claims you authorized
No guaranteed outcomes. SEO, content marketing, and digital visibility are influenced by many factors outside our control. We commit to professional, best-practice work. We do not guarantee specific rankings, traffic numbers, lead generation, or revenue outcomes
Plain English: We stand behind our work. If we mess something up, we will fix it. But we cannot be responsible for things outside our control, like Google changing their algorithm or information you gave us that turned out to be wrong.
13 Indemnification
You agree to indemnify and hold harmless ReadTomato, its owners, employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
Inaccurate information you provided that was published in content
Misrepresentation of your credentials, licensing, or professional standing
Your violation of any third-party rights through information or materials you provided to us
Your use of delivered content in ways that violate applicable laws or regulations
ReadTomato will indemnify you against claims arising directly from our negligence, our breach of these terms, or defects in our proprietary tools that cause demonstrable harm to your business or reputation.
14 Termination
Either party may terminate with 30 days written notice (email is sufficient)
All approved work in progress at the time of cancellation notice remains billable through the current production cycle
Upon termination:
Content already published to your website remains yours and stays live
Unpublished content that has been paid for will be delivered to you within 14 days
Unpublished content that has not been paid for is retained by ReadTomato
We will revoke our access to your website and accounts within 7 days
Your client portal and dashboards will remain accessible for 30 days after termination for you to download your content
Post-termination archiving: ReadTomato is not responsible for archiving, preserving, or maintaining access to files, recordings, or deliverables beyond 90 days after the termination date
ReadTomato-initiated termination: We may terminate for delinquency, non-cooperation, unreasonable demands, material breach, or legal or ethical concerns. If ReadTomato terminates without client breach, unused prorated fees for the current period will be refunded
Immediate termination may occur if either party materially breaches these terms and fails to cure within 14 days of written notice
Survival: Sections 3 (Content Ownership), 10 (Representations), 11 (Warranty Disclaimer), 12 (Limitation of Liability), and 13 (Indemnification) survive termination
15 Changes to Terms
We may update these terms from time to time. When we do, we will update the version number and effective date at the top of this page
For material changes, we will notify you via email at least 14 days before the changes take effect
Continued use of our services after the effective date of updated terms constitutes acceptance
If you disagree with updated terms, you may terminate per Section 14
16 General Provisions
Governing law: These terms are governed by the laws of the State of California, without regard to conflict of law provisions
Dispute resolution: Any disputes will first be addressed through good-faith negotiation. If unresolved after 30 days, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California
Entire agreement: These terms, together with any individual service agreement or proposal, constitute the entire agreement between you and ReadTomato
Severability: If any provision is found unenforceable, the remaining provisions continue in full force
No waiver: Our failure to enforce any provision does not waive our right to enforce it later
Assignment: You may not assign your rights under these terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets, with notice to you
17 DMCA Takedown Policy
ReadTomato respects the intellectual property rights of others and expects its Clients to do the same. If you believe that any content on a website created, managed, or hosted by ReadTomato infringes your copyright, you may submit a written notice to our designated Copyright Agent.
A description of the copyrighted work you claim has been infringed
The URL or specific location of the allegedly infringing material
Your contact information (name, address, telephone number, and email)
A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
Your physical or electronic signature
Our Response
Upon receipt of a valid DMCA notice, ReadTomato will promptly remove or disable access to the allegedly infringing material
We will notify the applicable Client whose website contained the material
ReadTomato reserves the right to terminate services for Clients who are repeat infringers
Plain English: If someone's copyrighted work ends up on a site we manage and shouldn't be there, tell us and we will take it down fast. We also hold our clients accountable if it keeps happening.

These terms (v1.2) are effective as of the date shown above and supersede all prior agreements regarding the services described herein.
